These terms and conditions apply to the use of this website at TPXsport.ie. By accessing this website and/or placing an order, you agree to be bound by these terms and conditions. Please read them carefully. They do not affect your statutory rights.
Using this website indicates that you accept these terms regardless of whether or not you choose to register with us or order from us. If you do not accept these terms, do not use this website.

This website is Evalon/RMS compliant as per EU Eftpos and Visa merchant standards. This verifies our business is protected from hackers and that your credit card details are safely stored (if applicable).
You will be liable for all orders placed using your credit card details and agree to indemnify TPX Sport against any losses, claims or damages arising from the use or misuse of your credit card details by any other person.
1. Introduction
1.1 You will be able to access most areas of this website without registering your details with us. Certain areas of this website are only open to you if you register.
1.2 We may revise these terms and conditions at any time by updating this posting. You should check this website from time to time to review the then current terms and conditions, because they are binding on you. Certain provisions of these terms and conditions may be superseded by expressly designated legal notices or terms located on particular pages of this website. If you do not wish to accept any new terms and conditions after we have given notice, you should not continue to use this website.
2. Ordering From Us
2.1 You are deemed to place an order with us by ordering via our online checkout process. As part of our checkout process you will be given the opportunity to check your order and to correct any errors. We will send you an order acknowledgement, detailing the products you have ordered.
2.2 Our acceptance of an order takes place when we despatch the order.
2.3 We may refuse to accept an order:
(a) where goods are not available;
(b) where we cannot obtain authorisation for your payment;
(c) if there has been a pricing or product description error; or
(d) if you do not meet any eligibility criteria set out in our terms and conditions.
3. Pricing
3.1 All prices include VAT (where applicable) at the current rates in Ireland.
3.2 Postage and packaging are charged separately, the appropriate rates are set out in our specified pricing structure shown elsewhere on this website.
4. Cancellation and Returns Policy
4.1 If you wish to cancel your order:
(a) You can notify us by email to info@tpxsport.ie before we have dispatched the goods to you or;
(b) Where goods have already been dispatched to you, by returning goods to us in accordance with clause 4.2 below.
4.2 You can return goods you have ordered from us for any reason at any time within 14 days of receipt for a full refund. The costs of returning goods to us shall be borne by you.
4.3 Upon receipt of the goods we will give you a full refund of the amount paid minus our original delivery cost.
4.4 The rights to return the goods to us as referred to in clause 4.2 and 4.3 will not apply in the following circumstances: - In the event that the product has been used or any products that we have made or customised specifically for you The provisions of this clause 4.4 do not affect your statutory rights.
5. Delivery
5.1 We use couriers as our Irish delivery option the costs of which are as follows:
0-2 Kg €3.50 + VAT (23%)
2-5 Kg €5.50 + VAT (23%)
5-30 Kg €6.80 + VAT (23%)
5.2 If you are ordering from a country within the European Union we will give you a specific quote for delivery separately.
5.3 Orders will be despatched within 48 hours for stock items, where items are out of stock we will notify you of an anticipated delivery date by email (see 6 below).
5.4 Orders over €350 in Ireland are dispatched free of charge. All International Orders will be charged at cost, we will inform you via email of charges before dispatch.
6. Online Backorders Policy
6.1 From time to time you may pay for a product that is not immediately available for shipping. You will be notified by email as soon as possible if product(s) you have ordered are out of stock and placed on backorder.
6.2 Backordered products will be delivered as soon as possible. You will be contacted by phone or email with a delivery time for your backordered product.
If you longer require the products, contact our office by phone or email to advise you no longer wish to receive your backordered product. The amount that you paid for the product will be refunded or a store credit will be given.
7. Intellectual Property Rights
7.1 Copyright of all text, graphics, logos and designs used in this website is owned or licensed by Speed Power & Stability Systems. You may access and print material from this website provided it is used for your personal use, and not for any commercial purpose.
7.2 Any reproduction of information on this website must include an acknowledgement of Speed Power & Stability Systems intellectual property rights in the relevant context.
7.3 Any word or device to which is attached the registered symbol (®) or TM symbol is a registered trademark. If you use any of our trademarks in reference to our imagery, activities, products or services, you must include a statement attributing that trademark to us.

8.1 TPX Sport is committed to the protection of your personal information. The information you provide may include your name, organisation , address, telephone numbers, email addresses and possibly credit card details. This information will never be sold or passed onto third parties unless required by government authorities, or, in the event of debt recovery.
8.2 The information you provide is for the purpose of delivering products and services to you and to administer and manage invoicing and debt collecting. It may also include status of any order you place with us.
8.3 We may occasionally use your information to contact you with special offers that we consider to be of relevant interest. If you do not wish to receive promotional offer emails or catalogues, please send an email with UNSUBSCRIBE in the subject line to office@tpxsport.ie.
8.4 Information is stored securely in paper or electronic form and is accessible only by authorised personnel. You have the right to request a copy of the information about you that we hold. If there is any detail that is not correct, you can request that we correct that detail. If in supplying your information we would reveal other people's information, we reserve the right to decline your request.
9. Year 100% Guarantee
9.1 We deliver innovative, high-quality and durable products that improve physical education, fitness, and athletic performance. TPS Sport stand behind all our products with a 12 month 100% manufacturers guarantee.
9.2 The warranty covers manufacturing defects. It does not cover improper use, incorrect assembly or fair wear and tear that may be common in commercial use; We will meet our full obligations to provide a remedy as stated under the Irish Sale of Goods and Supply of Services Act 1980 and EU Directive 1999/44/EC.
9.3 The warranty is provided to the original purchaser and is not transferable to any other party.
9.4 If you believe your item is faulty, please contact the office and provide the following information: Invoice number, date of purchase, description of item, best daytime contact number, and if possible photographic evidence of the fault. We will assess the information provided within 48 hours and either replace, refund or arrange for the item to be returned.
9.5 Every step will be taken to ensure that your goods are protected from damage during shipping. If you believe that damage has occurred during shipping please tell your delivery driver and ensure that they note packaging or product damage before you sign the Proof of Delivery.
9.6 Please advise us within 5 working days of any product damages. We will then assess whether damaged goods need to be returned for replacement or exchange. TPX Sport will comply with its obligations pursuant to the Irish Sale of Goods and Supply of Services Act 1980 and EU Directive 1999/44/EC.
10. Service Access
10.1 While we endeavour to ensure that this website is normally available 24 hours a day, we will not be liable if for any reason this website is unavailable at any time or for any period.
10.2 Access to this website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond our control.
11. We Use Cookies
Cookies allow TPX Sport to remember you. If we didn't use cookies you would have to enter your details each time you visited. If you really prefer not to use cookies you can set your browser preferences to not accept cookies. Most websites however, including ours require cookies to process your orders.
12. Product
12.1 We reserve the right to modify or change product specifications. We do this in order to improve our product range and availability. This will only be done when we consider the alternate product to be equal or better in performance and suitability. From time to time products may not exactly match photographs in this catalogue or on our website.
12.2 Every product is intended for use only for the activity described. Products to be used by children should only be used under proper adult supervision - the selection and suitability of items to be used by children remains at the discretion of the purchaser.
